The complainant has requested information relating to a planning enforcement dispute he was engaged in with Stratford-on-Avon District Council ("the Council"). The Council disclosed some information, but it withheld some information, under regulations 12(4)(e) (Internal communications), 12(5)(b) (Course of justice etc) and 12(5)(f) (Adverse affect to the interests of the provider) of the EIR. The complainant disagreed with the application of the exceptions and he also considered that not all of the information falling within scope of the request had been identified and disclosed to him. The Commissioner's decision is that, at the time of the request, the Council was entitled to rely on regulations 12(5)(b) and 12(5)(f) to withhold the information. He also finds that, on the balance of probabilities, the Council has disclosed all the information it held in respect of point (6) of the request.
