The complainant has requested unredacted copies of two published reports concerning unacceptable behaviour within the Royal Airforce Aerobatic Team (RAFAT) from the MoD. The MoD has refused to provide the requested information citing section 40(2) (Personal information) and section 38 (Endangering health and safety) The Commissioner's decision is that the MoD was entitled to rely on section 40(2) to withhold the requested information. He has not considered section 38. The Commissioner does not require the MoD to take any steps in relation to this complaint.
