The Commissioner's decision is that that Fermanagh and Omagh District Council ("the Council") is entitled to rely on regulation 12(4)(e) of the EIR to withhold some information relating to a specific newspaper article involving the Council. As part of the requested information falls under the FOIA the Commissioner's decision is also that the Council is entitled to rely upon section 30 of FOIA (investigations and proceedings) to withhold that part of the requested information. The Commissioner requires no steps to be taken.
