The complainant has requested information from the Nursing and Midwifery Council (NMC) concerning complaints where the complainant had alleged adverse treatment of any kind due to whistleblowing activity. The NMC relied on section 12(1) of FOIA (cost of compliance) to refuse the request. The Commissioner's decision is that the request engages section 12 and therefore the NMC was entitled to refuse it. However, in failing to provide reasonable advice and assistance, the NMC did not comply with its section 16(1) obligation. The Commissioner does not require further steps to be taken.
