The complainant has requested information relating to emails sent or received by a specific member of staff at Hertsmere Borough Council (the Council) in relation to breaches of a planning condition. The Commissioner's decision is that the Council has correctly applied regulation 12(4)(e) (internal communications) and 12(5)(f) (interests of the information provider) of the EIR to withhold some information falling within the scope of the request. However, in failing to provide some environmental information within 20 working days it breached regulation 5(2) of the EIR. It also breached regulation 11 of the EIR by failing to provide an internal review. The Commissioner does not require further steps.
