The complainant has requested the Equality Impact Assessment associated with the Government's intended changes to the Work Capability Assessment. The Commissioner's decision is that section 22(1) is not engaged and while section 35(1)(a) is engaged, the balance of the public interest favours disclosure. The Commissioner requires the Department for Work and Pensions (DWP) to disclose the requested information. The public authority must take these steps within 30 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
