The complainant has requested from University College London (UCL) the names of lochs that had been used as research sites to test the impact of fish farms and resulted in a Research Paper. UCL refused to provide the requested information, citing regulations 12(5)(f) - interests of the information provider and 12(5)(e) - commercial or industrial information. The Commissioner's decision is that UCL cited both regulations 12(5)(f) and (e) incorrectly. He has also found that UCL breached regulations 14(2) and 11(4) of the EIR by failing to issue a refusal notice within the statutory timeframe and not providing an internal review within 40 working days respectively. The Commissioner requires UCL to take the following steps to ensure compliance with the legislation.
