Summary
The applicant filed a divisional application outside the period set out under rule 24 for doing so. The examiner considered that there was no basis for allowing comptrollers discretion to extend this period. In exercising comptrollers discretion to extend the rule 24 period, the applicant was required to demonstrate that the circumstances for doing so were exceptional and that he had been properly diligent. The hearing officer concluded that the circumstances for requesting extension were not exceptional and refused to allow the late filing of the divisional application.
