The opposition was brought on the basis of a number of ‘human figure athlete’ marks registered in various classes and in respect of goods some of which were identical with those specified in the application.
After a detailed assessment of the respective marks, however, the Hearing Officer concluded that they were not similar. This effectively disposed of the opposition under all three headings.
