Summary
Confidentiality under Rule 53 was requested in respect of a document filed as evidence to rebut an inventive step objection, on the grounds that it contained valuable and commercially sensitive information. No argument was advanced as to why putting this document into the public domain would be harmful to the applicant. The Hearing Officer applied the criteria set out in Diamond Shamrock Technologies S.A.'s Patent [1987] RPC 91 and refused the request.
