MD v Secretary of State for Work and Pensions (UC) [2020] UKUT 215 (AAC) (6 July 2020)


Caselaw on regulation 35(2) of the Employment and Suppport Allowance Regulations, such as IM v SSWP (ESA) [2014] UKUT 412 (AAC); [2015] AACR 10, KC and MC v SSWP (ESA) [2017] UKUT 94 (AAC) and MR v SSWP (ESA) [2020 UKUT 210 (AAC), and the evidential obligations under that caselaw, apply just as much to Universal Credit and in particular Schedule 9(4) of the Universal Credit Regulations 2013.
