R (LXR) v First-tier Tribunal and the Criminal Injuries Compensation Authority (interested party) [2024] UKUT 208 (AAC) (16 July 2024)


Re-opening an award under paragraph 115(b) of the Criminal Injuries Compensation Scheme 2012, with particular reference to meaning of `condition'. Proper understanding and use of R v Criminal Injuries Compensation Board, ex parte Williams [2000] PIQR Q339. Williams did not decide that a misdiagnosis does not justify re-opening; the issue is still open. See R (Colefax) v First-Tier Tribunal (Social Entitlement Chamber) [2015] 1 WLR 35.
