The Criminal Injuries Compensation Authority v First-tier Tribunal (CIC) and Stone [2024] UKUT 3 (AAC) (2 January 2024)


A three-judge panel of the Upper Tribunal in R(SB) v CICA and the First-tier Tribunal [2014] UKUT 497 (AAC) decided the scope of an appeal to the First-tier Tribunal under the 1996 and 2001 Schemes. I have decided that the reasoning in SB in relation to reviews by CICA applies to the 2012 Scheme, as does its reasoning on appeals to the First-tier Tribunal, but with a minor modification that prevents the possibility of an irremediable error.
