The Tribunals and Inquiries (Discretionary Inquiries) (Amendment) Order 1976

The Lord Chancellor and the Lord Advocate, in exercise of the powers conferred on them by sections 16 and 19(2) of the Tribunals and Inquiries Act 1971, as amended by the Transfer of Functions (Secretary of State and Lord Advocate) Order 1972(1), hereby make the following Order:-

1. This Order may be cited as the Tribunals and Inquiries (Discretionary Inquiries) (Amendment) Order 1976 and shall come into operation on 29th March 1976.

2. The Interpretation Act 1889 shall apply to the interpretation of this Order as it applies to the interpretation of an Act of Parliament.

3. Part 1 of the Schedule to the Tribunals and Inquiries (Discretionary Inquiries) Order 1975(2) shall be amended as follows:-

(a)after paragraph 15 there shall be inserted the following paragraph:-

"15A. Any inquiry or hearing held under paragraph 4 of Schedule 1 to the Acquisition of Land (Authorisation Procedure) Act 1946(3), as modified by paragraph 2 of Schedule 4 to the Community Land Act 1975(4), not being an inquiry the holding of which is, under paragraph 4 as modified, obligatory."

; and

(b)after paragraph 20 there shall be inserted the following paragraph:-

"20A. Any inquiry or hearing held under paragraph 4 of Schedule 1 to the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947(5), as modified by paragraph 2 of Schedule 4 to the Community Land Act 1975, not being an inquiry the holding of which is, under paragraph 4 as modified, obligatory."

EXPLANATORY NOTE

This Order amends the Tribunals and Inquiries (Discretionary Inquiries) Order 1975 by including in the Schedule to that Order the discretionary inquiries specified, thus applying sections 1 and 11 of the Tribunals and Inquiries Act 1971 to those inquiries. This brings the specified inquiries within the jurisdiction of the Council on Tribunals and gives the Lord Chancellor and, in Scotland, the Lord Advocate power to make rules for regulating their procedure.
