The Civil Aviation (Notices) Regulations 1978

The Secretary of State in exercise of his powers under section 29(1), (3), (3A) and (4) of the Civil Aviation Act 1971, as amended by paragraph 6(4) and (5) of Schedule 1 to the Civil Aviation Act 1978, and of all other powers enabling him in that behalf hereby makes the following Regulations.

1.-(1) These Regulations may be cited as the Civil Aviation (Notices) Regulations 1978 and shall come into operation on 1st October 1978.

(2) The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament and as if these Regulations and the Regulations hereby revoked were Acts of Parliament.

(3) In these Regulations "the Act" means the Civil Aviation Act 1971.

2. The manner of publication of the notices referred to in section 29(1), (3) and (3A) of the Act shall be by setting forth the notices in a document published by the Civil Aviation Authority and entitled "United Kingdom Air Pilot" or "Notam".

3.-(1) The manner of giving a notice for the purposes of section 29(4)(e) of the Act shall be

(a)by delivering it in writing to the person managing the aerodrome; or

(b)by leaving it in writing at his proper address; or

(c)by giving it to him in writing by post; or

(d)by giving it to him otherwise than in writing,

and where the person managing the aerodrome is a body corporate, the notice may be given to the secretary of that body, or to any officer or employee of that body duly authorised to receive it.

(2) For the purposes of this Regulation the proper address of any person shall, in the case of a body corporate, be the registered or principal office of that body and in any other case be the last known address of the person to whom notice is to be given.

4. The Regulations specified in the Schedule hereto are hereby revoked.

EXPLANATORY NOTE

These Regulations prescribe the manner of publishing and giving notices under section 29 of the Civil Aviation Act 1971 as amended by Schedule 1 of the Civil Aviation Act 1978 and also revoke the earlier Regulations made under that section.
