1. This order may be cited as the National Heritage Act 1983 (Commencement No. 2) Order 1983.

2. The following provisions of the National Heritage Act 1983 (relating to the establishment of the Board of Trustees of the Royal Botanic Gardens, Kew) shall come into force on 8th August 1983:-

(a)sections 23 and 29,

(b)Part IV of Schedule 1, and

(c)paragraphs 3 and 4 of Schedule 5 so far as they relate to the Royal Botanic Gardens, Kew.

EXPLANATORY NOTE

This order brings into force on 8th August 1983 the provisions of sections 23 and 29 of the National Heritage Act 1983 together with Part IV of Schedule 1. These relate to the establishment of the Board of Trustees of the Royal Botanic Gardens, Kew.

This order also brings into force paragraphs 3 and 4 of Schedule 5 to the Act so far as they relate to the Gardens. Paragraph 3 inserts the Gardens into the list of establishments and organisations whose administrative and departmental records are public records for the purposes of the Public Records Act 1958 (c. 51). Paragraph 4 inserts the Board of Trustees of the Gardens into the list of institutions which so far as they are charities are exempt charities within the meaning of that Act.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the Act have been brought into force by commencement order which was made on 20th July 1983.

and the following provisions of the Act will be brought into force by that commencement order after the date of this order:-
