The Building Act 1984 (Commencement No. 1) Order 1985

21st October 1985

The Secretary of State, in exercise of the powers conferred upon him by sections 120(1) and 134(1) of the Building Act 1984, and of all other powers enabling him in that behalf, hereby makes the following order:-

1. This order may be cited as the Building Act 1984 (Commencement No. 1) Order 1985.

2. 11th November 1985 is appointed as the day on which section 50(2) and (3) of the Building Act 1984 comes into force.

EXPLANATORY NOTE

Under the Building Act 1984 the responsibility for ensuring compliance with building regulations may, at the option of the person intending to carry out the work, be given to an approved inspector instead of the local authorities. The procedure is dealt with in the Building (Approved Inspectors etc.) Regulations 1985 (S.I. 1985/1066) which come into full operation on 11th November 1985.

This order brings section 50(2) and (3) into force on the same date to enable disagreements with approved inspectors as to whether plans of proposed work comply with building regulations to be determined by the Secretary of State.
