The Public Transport Companies (Permitted Maximum and Required Minimum Numbers of Directors) Order 1985

The Secretary of State for Transport (as respects England), the Secretary of State for Scotland (as respects Scotland) and the Secretary of State for Wales (as respects Wales), in exercise of the power conferred by section 73(6) of the Transport Act 1985 (hereinafter called "the Act") and of all other powers enabling them in that behalf, hereby make the following Order:-

1. This Order may be cited as thePublic Transport Companies (Permitted Maximum and Required Minimum Numbers of Directors) Order 1985 and shall come into operation on 6th January 1986.

2. The permitted maximum number for the purposes of subsection (1) of section 73 of the Act is seven.

3. The required minimum number for the purposes of subsection (2) of that section is-

(a)where the number of vehicles owned by the company and used or appropriated for use in providing any service for the carriage of passengers by road which requires a PSV operator's licence is less than fifty, two; and

(b)where the number of such vehicles is fifty or more, three.

4. For the purposes of article 3 of this Order, a vehicle shall be treated as owned by the company if it is-

(a)owned by a subsidiary of the company; or

(b)in the possession of the company, or of any subsidiary of the company, under an agreement for hire, hire-purchase, conditional sale or loan.

EXPLANATORY NOTE

This Order prescribes seven as the permitted maximum number of persons who are not full-time employees of a public transport company who may be directors of such a company. It also prescribes three as the required minimum number of persons who are full-time employees of the company, in positions of responsibility for the management of the company's business or any part of that business, who are to be directors of the company where the company owns 50 or more buses. In cases where the company owns less than 50 buses, the required minimum is two.

The meaning of the expression "public transport company" is given in section 72(1) of the Transport Act 1985.
