BETTING, GAMING AND LOTTERIES

The Gaming Act (Variation of Monetary Limits) Order 1988

In pursuance of sections 21(8), 41(9) and 51(4) of the Gaming Act 1968(1), I hereby make the following Order:-

1.-(1) This Order may be cited as the Gaming Act (Variation of Monetary Limits) Order 1988 and shall come into force on 18th July 1988.

(2) This Order shall not extend to Scotland.

2. In section 21(2) of the Gaming Act 1968(2) (conditions on which gaming for prizes is permitted at licensed club premises) paragraphs (b) and (e) shall have effect as if, for the sum of £15 specified in each of those paragraphs, there were substituted the sum of £20.

3.-(1) The provisions of section 41 of the Gaming Act 1968 (gaming at entertainments not held for private gain) specified in column 1 of the Schedule to this Order (which relate to the maximum sums permitted in respect of the matters mentioned in column 2 of that Schedule) shall have effect as if, for the references in those provisions to the sums specified in column 3 of that Schedule (which were substituted by the Gaming Act (Variation of Monetary Limits) Order 1984(3)), there were substituted references to the sums specified in column 4 of that Schedule.

(2) Paragraph (1) above shall have effect only in relation to entertainments held on or after the date on which this Order comes into force.

4. In the Gaming Act (Variation of Monetary Limits) Order 1984-

(a)in article 3, for the words"Paragraphs (a), (b), (c), and (e)" there shall be substituted the words"Paragraphs (a) and (c)", and paragraphs (b) and (d) shall be omitted; and

(b)article 4 and the Schedule shall be omitted.

Explanatory Note

(This note is not part of the Order)

This Order increases in England and Wales certain monetary limits specified in sections 21(2) and 41 of the Gaming Act 1968.

Article 2 increases the maximum amounts permitted-

(a)to be taken by way of the sale of chances; and

(b)as the aggregate amount or value of prizes,

on any one determination of winners in gaming for prizes at licensed club premises under section 21 of the 1968 Act.

Article 3 increases the maximum limits specified in section 41 of the 1968 Act for the prizes, stakes and other matters mentioned in the Schedule to the Order.
