The Secretary of State for Transport, in exercise of the powers conferred by sections 12(1) and 37(2) of the Vehicles (Excise) Act 1971(1), and of all other enabling powers, hereby makes the following Regulations:
1. These Regulations may be cited as the Road Vehicles (Excise) (Prescribed Particulars) (Amendment) Regulations 1988 and shall come into force on 1st June 1988.
2. The Road Vehicles (Excise) (Prescribed Particulars) Regulations 1981(2) shall be further amended in accordance with the following provisions of these Regulations.
3.-(1) Regulation 3 shall be renumbered as paragraph (1) of that regulation and after that provision as so renumbered there shall be inserted the following new paragraphs-
"(2) In Schedule 1 to these Regulations "Vehicles mentioned in regulation 3(2) of these Regulations" means vehicles-
(a)which are heavy motor cars used for the carriage of exceptional loads; or
(b)which are heavy locomotives, light locomotives or motor tractors used to draw trailers carrying such loads,
and which, when so used, are authorised for use on roads by virtue of an order under section 42 of the Road Traffic Act 1972(3).
(3) In this regulation-
"exceptional load" means a load which-
(a)by reason of its dimensions, cannot be carried by a heavy motor car or trailer, or a combination of a heavy motor car and trailer, which (in either case) complies in all respects with requirements of regulations under section 40 of the Road Traffic Act 1972; or
(b)by reason of its weight, cannot be carried by a heavy motor car or trailer, or a combination of a heavy motor car and trailer, which (in either case) has a total laden weight of not more than the specified amount and complies in all respect with such requirements;
"specified amount" means-
(a)in relation to any time before 1st October 1989, 32,520 kilograms;
(b)in relation to any time on or after that date, 38,000 kilograms;
and other expressions which are also used in the Road Traffic Act 1972 have the same meanings as in that Act.".
(2) In Schedule 1, after the entry numbered 9, there shall be inserted the new entry numbered 9A set out in the Schedule to these Regulations.

These Regulations further amend the Road Vehicles (Excise) (Prescribed Particulars) Regulations 1981.
Regulation 3, with the Schedule, makes provision for the class of vehicles used for carrying or drawing exceptional loads, established with effect from 1st June 1988 under a resolution pursuant to section 5 of the Provisional Collection of Taxes Act 1968 (c. 2) which was passed by the House of Commons on 15 March 1988.
