The Criminal Justice Act 1988 (Commencement No. 9) Order 1989

In exercise of the powers conferred on me by section 171(1) of the Criminal Justice Act 1988(1), I hereby make the following Order:

1. This Order may be cited as the Criminal Justice Act 1988 (Commencement No. 9) Order 1989.

2. The following provisions of the Criminal Justice Act 1988 shall come into force on 26th September 1989-�

(a)Section 1(9) to the extent necessary to bring into force Part II of Schedule 1; and

(b)Part II of Schedule 1 (amendment of the Backing of Warrants (Republic of Ireland) Act 1965(2) to introduce into that Act provisions corresponding to certain provisions of Part I of the Criminal Justice Act 1988).

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 26th September 1989 provisions of the Criminal Justice Act 1988 which insert in the Backing of Warrants (Republic of Ireland) Act 1965 a new section 2A concerned with appeals by way of case stated. (Sections 1 to 21 of and Schedule 1 to the Criminal Justice Act 1988 are repealed and (with the exception of that amendment of the 1965 Act) re-enacted by the Extradition Act 1989 (c. 33) which comes into force on 27th September 1989 (section 38(2)). Section 2A of the 1965 Act is saved by section 37(5) of the Extradition Act 1989.)
