SOCIAL SECURITY

The Social Security Act 1989 (Commencement No. 3) Order 1990

Made

17th January 1990

The Secretary of State for Social Security, in exercise of powers conferred upon him by section 33(2) of the Social Security Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.-(1) This Order may be cited as the Social Security Act 1989 (Commencement No. 3) Order 1990.

(2) In this Order, unless the context otherwise requires, references to sections and Schedules are references to sections of and Schedules to the Social Security Act 1989.

Appointed days

2. The day appointed for the coming into force of-�

(a)section 22(3) and Schedule 4, paragraph 1, together with section 22(7) so far as it relates to it (definitions), is 18th January 1990;

(b)the provisions of the Act specified in Schedule 1 to this Order, for the purpose only of authorising the making of regulations which are expressed to come into force on or after 2nd April 1990, is 18 January 1990;

(c)Schedule 3, paragraphs 3(1), 8, 10 and 11(2) (adjudication), for the purpose only of authorising the making of regulations which are expressed to come into force on 6th April 1990, is 1st February 1990;

(d)the provisions of-�

(i)section 22(4) (definitions)

(ii)section 25(1), (2) and (3), for the purpose only of authorising the making of regulations which are expressed to come into force on 1st January 1991, and

(iii)Schedule 3, paragraph 16 (Parliamentary control of regulations),

is 1st March 1990;

(e)Schedule 4 paragraph 13 (information) in so far as not already in force and section 22(7) (recovery of sums equivalent to benefit from compensation payments in respect of accidents, injuries or diseases) in so far as it relates to it, is 2nd April 1990;

(f)the provisions of the Act specified in Schedule 2 to this Order in so far as they are not already in force is 6th April 1990;

(g)Schedule 4, paragraphs 3, 14, 15(1)(a) and (b), 16 and 17(4)(b) (certificates of total benefit) and section 22(7) in so far as it relates to them, is 9th July 1990;

(h)section 22 (recoupment) and Schedule 4, in so far as they are not already in force, is 3rd September 1990;

(i)section 25 (war pensions committees), in so far as it is not already in force, is 1st January 1991.

    in section 112, subsection (4), and, in subsection (5), the words "or reference" and the words from "and the medical" onwards;

(v)in Schedule 11, paragraph 4;

(vi)in Schedule 13, paragraphs 8 and 9;

(vii)in Schedule 20, the definition of "local office" .

The following provisions have been brought into force by the combined effect of the Social Security Act 1989 (Commencement No. 1) Order 1989 (S.I. 1989/1238), and the Social Security Act 1989 (Commencement No. 2) Order 1989 (S.I. 1989/1262) both made before the date of this Order.
