The Housing Support Grant (Scotland) Order 1990

Made

The Secretary of State, in exercise of the powers conferred on him by sections 191 and 192 of the Housing (Scotland) Act 1987(1), and of all other powers enabling him in that behalf, and after such consultation with such associations of local authorities as appear to him to be concerned as is required by the said sections 191 and 192, and with the consent of the Treasury, hereby makes the following Order, a draft of which has been approved by the House of Commons:

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Housing Support Grant (Scotland) Order 1990 and shall come into force on 1st April 1990.

(2) In this Order-�

"the 1987 Act" means the Housing (Scotland) Act 1987;

"appropriate local authority" means a local authority other than an authority whose eligible expenditure and relevant income have been left out of account by virtue of section 191(5) of the 1987 Act; and

"the number of houses of the authority" means the estimate of the number of houses to which the housing revenue account of the authority at 30th September 1990 relates.

(3) Except where the context otherwise requires-�

(a)any reference to a numbered article or Schedule is a reference to the article or Schedule bearing that number in this Order; and

(b)any reference to any type of expenditure, charge or income which is estimated is a reference to such an estimate made by the Secretary of State.

Aggregate grant for 1990-91

2. The aggregate amount of the housing support grants for 1990-91 shall be £59,568,643.

Apportionment of aggregate grant for 1990-91

3.-(1) The aggregate amount of the housing support grants for the year 1990-91 shall be divided into two portions hereinafter referred to as the "general portion" and the "hostel portion".

(2) The general portion shall amount to £58,234,951 and shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures assessed in the manner provided in the Schedule to this Order.

(3) The hostel portion shall amount to £1,333,692 and shall be apportioned among appropriate local authorities in proportion to their estimated net expenditures for the year 1990-91 in relation to those buildings specified in paragraph 1(e) of Schedule 15 to the 1987 Act (which specifies lodging houses and hostels as buildings for the purposes of a local authority's housing revenue account).

SCHEDULEASSESSMENT OF ESTIMATED NET EXPENDITURE FOR APPORTIONMENT OF THE GENERAL PORTION OF THE AGGREGATE AMOUNT OF HOUSING SUPPORT GRANTS AMONG APPROPRIATE LOCAL AUTHORITIES FOR 1990-91

The estimated net expenditure of an appropriate local authority shall be the amount arrived at by addition of the amounts specified in items 1 to 7 below less the amounts specified in items 8 and 9 below.

1. Estimated loan charges due to be debited to the authority's housing revenue account for the year 1990-91 under paragraph 3(a) of Schedule 15 to the 1987 Act (other than loan charges in respect of hostels and lodging houses).

2. £92.909089 multiplied by the number of houses of the authority.

3.-(a) £37.163637 in the case of an authority with not more than 3,000 houses, or

(b)£18.581818 in the case of an authority with more than 3,000 but not more than 6,000 houses, or

(c)£9.290909 in the case of an authority with more than 6,000 but not more than 9,000 houses,

multiplied in each case by the number of houses of the authority.

4. £279.231672 multiplied by the number of houses of the authority.

5. £432.809092 multiplied by the number of high-rise houses of the authority contained in blocks of flats which are of fifteen or more storeys.

6. £195.462170 multiplied by the number of high-rise houses of the authority contained in blocks of flats which are of more than four but not more than fourteen storeys, with lifts.

7. Estimated other miscellaneous expenditure which may properly be included in the authority's housing revenue account.

8. £1,107.73 multiplied by the number of houses of the authority excluding certain houses leased by the authority for short term occupation without, or with nominal, rental income.

9. Estimated other miscellaneous income which may properly be included in the authority's housing revenue account, excluding a general fund contribution which for the year 1990-91 has been estimated at nil.

Explanatory Note

(This note is not part of the Order)

This Order fixes for the year 1990-91 the estimated aggregate amount of the housing support grants payable to certain local authorities under section 191 of the Housing (Scotland) Act 1987 and prescribes the method of apportionment among those authorities of the general and hostel portions of that amount.
