The Secretary of State for the Environment in exercise of the powers conferred by sections 2(9) and 15(5) of the Local Government Act 1988(1) and all other powers enabling him in that behalf hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (England) (No. 2) Order 1990 and shall come into force on 1st April 1990.
2. In this Order-
"the Act" means the Local Government Act 1988;
"cleaning" means the cleaning of buildings transferred to an authority mentioned in article 4 hereof by the Education (Inner London Education Authority) (Property Transfer) Order 1990(2);
"catering" means catering for the purposes of schools so transferred; and
"vehicle maintenance" means the repair and maintenance of vehicles so transferred.
3. Cleaning, catering and vehicle maintenance, being, respectively, defined activities within section 2(2)(b), (d) and (g) of the Act, shall not be treated as such activities if carried out by a specified authority before the date specified in relation to that activity and that authority in the table in the Schedule hereto.
4. For the purpose of this Order the specified authorities are-
(a)the councils of the London boroughs of Lambeth, Southwark, Greenwich, Lewisham;
(b)the councils of the London boroughs of Kensington and Chelsea, Wandsworth, Camden, Hackney, Tower Hamlets;
(c)the common Council of the City of London in its capacity as a local authority and the councils of the London boroughs of Hammersmith and Fulham, Islington, Westminster.

Under Part I of the Local Government Act 1988 work in connection with certain activities may only be undertaken by local authorities if particular conditions are complied with. The conditions effectively require that the work be put out to tender.
This Order exempts certain work from the requirements of Part I until the relevant date set out in the Schedule if it is undertaken by the Common Council of the City of London or the Council of an Inner London borough.
The work in question is the Cleaning of buildings transferred to any of these authorities by the Education (Inner London Education Authority ) (Property Transfer) Order 1990; the repair and maintenance of vehicles so transferred; and catering for the purposes of schools so transferred.
