The Secretary of State for Trade and Industry, in exercise of the powers conferred on him by sections 9(5) and 18(5) of the Restrictive Trade Practices Act 1976(1), hereby makes the following Order:-

Citation, commencement and interpretation

1.-(1) This Order may be cited as the Restrictive Trade Practices (Standards and Arrangements) Order 1990 and shall come into force on 11th April 1990.

(2) In this Order

Approval of standards and arrangements

2.-(1) The standards specified in Part I of the Schedule to this Order, being standards adopted by Electricity Association Services Limited on 6th April 1990 are hereby approved for the purposes of sections 9(5) and 18(5) of the 1976 Act.

(2) The arrangements specified in Part II of the Schedule to this Order, being arrangements adopted by Electricity Association Services Limited on 6th April 1990, are hereby approved for the purposes of sections 9(5) and 18(5) of the 1976 Act.

This Order approves standards of dimension, design, quality or performance of goods and manufacturing processes and of performance in the provision of services, and arrangements as to the provision of information or advice, all of which have been adopted by Electricity Association Services Limited. The effect of the Order is that, for the purpose of determining whether an agreement is one to which the Restrictive Trade Practices Act 1976 applies, no account is taken of any term in the agreement by which the parties or any of them agree to comply with, or to apply, the standards and arrangements so approved.

The standards and arrangements (other than those which are confidential) may be inspected at the premises of Electricity Association Services Limited, 30 Millbank, London SW1P 4RD.
