The Education (Grants) (Music and Ballet Schools) (Amendment) Regulations 1993

In exercise of the powers conferred by section 100(1)(b) and (3) of the Education Act 1944(1) and vested in the Secretary of State(2), the Secretary of State for Education hereby makes the following Regulations:

1.-(1) These Regulations may be cited as the Education (Grants) (Music and Ballet Schools) (Amendment) Regulations 1993 and shall come into force on 27th August 1993.

(2) These Regulations shall apply in relation to a school year beginning on or after the date mentioned in paragraph (1).

(3) In these Regulations-�

(a)a reference to the principal Regulations is a reference to the Education (Grants) (Music and Ballet Schools) Regulations 1989(3); and

(b)a reference to the Aided Pupil Scheme is a reference to the scheme described in Schedule 1 to the principal Regulations,

and the amendments to the Aided Pupil Scheme contained in these Regulations shall be made to Schedule 1 to the principal Regulations.

2. In regulation 8D(1)(a) of the principal Regulations, after the words "Durham and Exeter" there shall be inserted the words "King's School, Ely" and after the word "Salisbury" there shall be inserted the words "Wells Cathedral".

3. In paragraph 8(3) and (4) of the Aided Pupil Scheme (references to income) for the sum "£1,105" there shall be substituted the sum "£1,125" in each place where it occurs.

4. In paragraph 13 of the Aided Pupil Scheme (remission of fees -� boarding pupils)-�

(a)in sub-paragraph (2), for the sum "£7,795" there shall be substituted the sum "£7,940"; and

(c)for the Table in sub-paragraph (3), there shall be substituted the following Table-�

5. In paragraph 14(2) and (3) of the Aided Pupil Scheme, for the sums "£9,800" and "£9,651" there shall be substituted the sums "£9,983" and "£9,834" respectively.

6. For sub-paragraphs (3) and (4) of paragraph 17 of the Aided Pupil Scheme (uniform grants) there shall be substituted the following sub-paragraphs-�

"(3) Unless an aided pupil has been a pupil at the school before taking up an aided place, in a pupil's first year at the school uniform grant shall be payable in the case of an aided pupil as respects whom the relevant income does not exceed £10,318 and in such case the grant shall be of an amount equal to so much of the clothing expenditure as does not exceed-�

(a)£158, where the relevant income does not exceed £9,059;

(b)£118, where that income exceeds £9,059 but does not exceed £9,480;

(c)£77, where that income exceeds £9,480 but does not exceed £9,887;

(d)£39, where that income exceeds £9,887 but does not exceed £10,318:

(4) Except where sub-paragraph (3) applies, uniform grant shall be payable in the case of an aided pupil as respects whom the relevant income does not exceed £9,887 and in such case the grant shall be of an amount equal to so much of the clothing expenditure (disregarding expenditure in respect of which a previous grant has been paid) as does not exceed-�

(a)£58, when the relevant income does not exceed £9,225;

(b)£30, where the income exceeds £9,225 but does not exceed £9,887.".

7. In paragraph 23(1) of the Aided Pupil Scheme (school travel grants) for the sums "£9,069" and "£8,890" there shall be substituted the sums "£9,238" and "£9,059" respectively.

8. In paragraph 3 of the Appendix to the Aided Pupil Scheme-�

(a)at the end of sub-paragraph (n) the word "or" shall be deleted;

(b)at the end of sub-paragraph (o) the word "or" shall be inserted;

(c)after sub-paragraph (o) there shall be inserted the following sub-paragraph-�

"(p)in pursuance of section 59 of and Schedule 10 to the Finance (No. 2) Act 1992 (relief for letting furnished accommodation in owner occupied homes).".

9. In paragraph 4 of the Appendix to the Aided Pupil Scheme, for the words "pursuant to a scheme approved by the Secretary of State under section 50(4) of the Adoption Act 1958" there shall be substituted the words "pursuant to regulations made under section 57A of the Adoption Act 1976(4)", and for the words "pursuant to section 34(6) of the Children Act 1975" there shall be substituted the words "under paragraph 15 of Schedule 1 to the Children Act 1989(5), any assistance given by a local authority in cash under paragraph 5 of Schedule 2 to that Act and any payment made by a local authority under paragraph 16 of that Schedule".

10. In paragraph 5(3)(a) of the Appendix to the Aided Pupil Scheme, after the words "(whether in the United Kingdom or elsewhere)" there shall be inserted the words "under any arrangement made by the Child Support Agency pursuant to the Child Support Act 1991(6)".

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 27th August 1993 amend the Education (Grants) (Music and Ballet Schools) Regulations 1989.

The Choir schools at King's School, Ely and Wells Cathedral are included in the choir schools specified by regulation 8D(1)(a) of the 1989 Regulations (regulation 2).

The reductions to be made in relevant income in respect of dependent relatives pursuant to paragraph 8(3) and (4) of the Aided Pupil Scheme are increased to so that the minimum reduction is now set at £1,125 instead of £1,105 (regulation 3).

The means test for the remission of fees is relaxed; the level of income at or below which fees are to be wholly remitted is set at £7,940 instead of £7,795 in respect of boarding pupils and £9,983 instead of £9,800 in respect of day pupils, with corresponding increases in the extent of remission where relevant income exceeds that sum (regulations 4 and 5). The means tests for uniform grants and school travel grants have also been relaxed (regulations 6 and 7).

References to the relevant income tax legislation in the Appendix to the Aided Pupil Scheme are updated so as to discount relief for letting furnished accommodation in owner occupied homes (regulation 8). The Aided Pupil Scheme has also been amended to update the references to the legislation relating to the adoption and fostering of children (regulation 9) and so that maintenance payments made under any arrangement by the Child Support Agency are deducted from the income of the person making the payments and included in the income of the person receiving them (regulation 10).
