The Social Security (Overlapping Benefits) Amendment (No. 2) Regulations 1999

Coming into force in accordance with regulation 1(2)

The Secretary of State for Social Security, in exercise of the powers conferred by sections 73(1)(a) and 189(1), (3), (4) and (5) of the Social Security Administration Act 1992(1) and of all other powers enabling him in that behalf, and whereas, by reason of the urgency of the matter, it appears to the Secretary of State to be inexpedient to refer proposals in respect of these Regulations to the Social Security Advisory Committee(2), hereby makes the following Regulations:

Citation and commencement

1.-(1) These Regulations may be cited as the Social Security (Overlapping Benefits) Amendment (No. 2) Regulations 1999.

(2) Subject to paragraph (3), these Regulations shall come into force on 17th May 1999.

(3) These Regulations shall come into force-

(a)on 18th May 1999, where in any particular case guardian's allowance is payable (other than a case where the Secretary of State has arranged for guardian's allowance to be payable on a Monday);

(b)on 20th May 1999, where in any particular case the weekly rate of incapacity benefit or severe disablement allowance is increased in respect of a child or children.

Amendment to regulation 8 of the Social Security (Overlapping Benefits) Regulations1979

2. In regulation 8(2) of the Social Security (Overlapping Benefits) Regulations 1979(3) there shall be substituted for the figure £0.75 in both places where it occurs the figure £3.35.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Social Security (Overlapping Benefits) Regulations 1979 (S.I. 1979/597) by altering the amount of the adjustment of certain benefits payable under the Social Security Contributions and Benefits Act 1992.

These Regulations do not impose any costs on business.
