The Social Fund Winter Fuel Payment (Temporary Increase) Regulations 2000

The Secretary of State for Social Security, in exercise of the powers conferred upon him by sections 138(2) and (4) and 175(1) and (3) of the Social Security Contributions and Benefits Act 1992(1) and of all other powers enabling him in that behalf, without having referred these Regulations to the Social Security Advisory Committee as it appears to the Secretary of State that by reason of urgency it is inexpedient so to refer them(2), hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Social Fund Winter Fuel Payment (Temporary Increase) Regulations 2000 and shall come into force on 11th November 2000.

Modification of the Social Fund Winter Fuel Payment Regulations 2000

2. For the purposes of making social fund winter fuel payments in respect of the winter which immediately precedes the spring of the year 2001, regulation 2(b) of the Social Fund Winter Fuel Payment Regulations 2000(3) (social fund winter fuel payments) shall be modified as if-

(a)in head (i) for the reference to £150 there were substituted a reference to £200; and

(b)in head (ii) for the reference to £75 there were substituted a reference to £100.

Explanatory Note

(This note is not part of the Regulations)

These Regulations modify the Social Fund Winter Fuel Payment Regulations 2000 by increasing the amount of money payable to persons out of the social fund in respect of expenses for heating which appear to the Secretary of State to be likely to be incurred in cold weather during the coming winter.

These Regulations have not been referred to the Social Security Advisory Committee pursuant to section 172(1) of the Social Security Administration Act 1992 ("the Administration Act") as it appears to the Secretary of State that by reason of the urgency of the matter, it is inexpedient so to refer them (see section 173(1)(a) of the Administration Act). They shall be referred to the Committee as soon as practicable after the date on which they have been made (see section 173(2) of the Administration Act).

These Regulations do not impose a charge on business.
