INVESTIGATORY POWERS

The Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) (Amendment) Order 2002

  Laid before Parliament 10th May 2002 
  Coming into force 17th June 2002 

The Secretary of State, in exercise of the powers conferred on him by section 30(1) and (3) and section 78(5) of the Regulation of Investigatory Powers Act 2000[1], hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) (Amendment) Order 2002 and shall come into force on 17th June 2002.

    
2. In Part I of the Schedule to the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) Order 2000[2] -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Regulation of Investigatory Powers (Prescription of Offices, Ranks and Positions) Order 2000 by changing the offices, ranks and position proscribed in respect of the National Criminal Intelligence Service ("NCIS"). The Order provides that for NCIS the persons designated for the purposes of granting an authorisation under section 28 and section 29 of the Regulation of Investigatory Powers Act 2000 are, in addition to a Superintendent, any individual holding a position at Grade M4, or any individual on secondment to NCIS who holds an office, rank or position which is designated for this purpose in the public authority from where he is seconded. The Order similarly amends the offices, ranks and positions in NCIS prescribed for urgent cases.
