The Airport Byelaws (Designation) Order 2005

  Made 21st February 2005 
  Laid before Parliament 23rd February 2005 
  Coming into force 16th March 2005 

The Secretary of State, in exercise of the powers conferred upon him by section 63(1) of the Airports Act 1986 [1] hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Airport Byelaws (Designation) Order 2005 and shall come into force on 16th March 2005.

Designation
    
2. Doncaster Sheffield Airport is hereby designated for the purposes of section 63 of the Airports Act 1986.

EXPLANATORY NOTE

(This note is not part of the Order)


Section 63(1) of the Airports Act 1986 provides that where an airport is either designated for the purposes of that section, or is managed by the Secretary of State, the airport operator (whether the Secretary of State or some other person) may make byelaws for regulating the use and operation of the airport and the conduct of all persons while within the airport. This Order designates Doncaster Sheffield Airport for the purposes of section 63.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.

[1] 1986 c. 31. Section E4 of Schedule 5 to the Scotland Act 1998 (c.46) states that the subject matter of section 63 of the Airports Act 1986 is not reserved. By virtue of section 53 of the Scotland Act 1998 (c.46) the functions of the Secretary of State under section 63 of the Airports Act 1986 (c. 31) are exercisable by the Scottish Ministers.back
