CONSUMER PROTECTION

The Enterprise Act 2002 (Part 8) (Designation of the Consumers' Association) Order 2005

  Made 22nd March 2005 
  Laid before Parliament 30th March 2005 
  Coming into force 22nd April 2005 

Whereas the Secretary of State thinks that the Consumers' Association has as one of its functions the protection of the collective interests of consumers and that it satisfies the criteria in article 3 of the Enterprise Act 2002 (Part 8 Designated Enforcers: Criteria for Designation, Designation of Public Bodies as Designated Enforcers and Transitional Provisions) Order 2003[1];

     Now therefore the Secretary of State, in exercise of her powers under section 213 of the Enterprise Act 2002[2] hereby makes the following Order:

Citation and Commencement
     1. This Order may be cited as the Enterprise Act 2002 (Part 8) (Designation of the Consumers' Association) Order 2005 and shall come into force on 22nd April 2005.

Designation of the Consumers' Association
    
2. The Consumers' Association (registered charity number 296072) is hereby designated under section 213(2) of the Enterprise Act 2002 as a designated enforcer in respect of all infringements.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order designates the Consumers' Association as a designated enforcer under Part 8 of the Enterprise Act 2002. Designated enforcers may take action to obtain enforcement orders to restrain those domestic and Community infringements in respect of which the enforcer is designated where those infringements harm the collective interests of consumers. This Order designates the Consumers' Association in respect of all infringements to which Part 8 applies.

A regulatory impact assessment has not been produced for this Order as it has no impact on the costs of business.
