The European Communities (Definition of Treaties) (WIPO Copyright Treaty and WIPO Performances and Phonograms Treaty) Order 2005

  Made 14th December 2005 
  Coming into force 1st February 2006 

At the Court at Buckingham Palace, the 14th day of December 2005

Present,

The Queen's Most Excellent Majesty in Council

Whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972[1] and has been approved by a resolution of each House of Parliament:

     Now, therefore, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

     1. This Order may be cited as the European Communities (Definition of Treaties) (WIPO Copyright Treaty and WIPO Performances and Phonograms Treaty) Order 2005 and shall come into force on 1st February 2006.

    
2. Each of the treaties specified in the Schedule to this Order is to be regarded as a Community Treaty as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE
The World Intellectual Property Organisation (WIPO) Copyright Treaty[2] signed by the United Kingdom on 13th February 1997.

The World Intellectual Property Organisation (WIPO) Performances and Phonograms Treaty[3] signed by United Kingdom on the 13th February 1997.



EXPLANATORY NOTE

(This note is not part of the Order)


This Order declares the WIPO Copyright Treaty and the WIPO Performances and Phonograms Treaty to be Community Treaties as defined in section 1(2) of the European Communities Act 1972. These treaties were signed by the United Kingdom on 13th February 1997 and at other times by the European Community, the other Member States of the European Community and many other states.

The WIPO Copyright Treaty updates and strengthens international standards of protection for literary and artistic works, in particular to take account of digital technology.

The WIPO Performances and Phonograms Treaty fulfils a similar function in relation to sound recordings (phonograms) and the rights of certain performing artists.
