Amendment of the Petroleum Revenue Tax (Nomination Scheme for Disposals and Appropriations) Regulations 1987
2.
The Petroleum Revenue Tax (Nomination Scheme for Disposals and Appropriations) Regulations 1987 are amended as follows.

In the title and citation of those Regulations—

In regulation 2 (interpretation)—

For regulation 2A substitute—

For regulation 3(2) and (3) (manner of making nominations) substitute—
(b) be transmitted to the Commissioners—
(3) For the purpose of determining whether the nomination is made within the period of two hours mentioned in paragraph 4(1)(a) or (1A)(a) of Schedule 10, the time of sending the transmission is to be used.
(3A) But transmission shall not be regarded as having been effected for the purposes of paragraph (2) until the nomination is received by the Commissioners at that address or number.".

In regulation 3(4) omit "(c)(v) above".

Omit regulations 4 to 6.

For regulations 7 and 8 substitute—

In regulation 9 (nominal volume)—

In regulation 10 (maximum tolerance) for "5" substitute "1".

Omit regulations 11 to 18.

In regulation 19 (nominations of proposed transactions in blended oil having effect with respect to more than one field)—
(b) omit paragraph (2).

[3] The functions of the Commissioners of Inland Revenue ("the former Commissioners") were transferred to the Commissioners for Revenue and Customs ("the new Commissioners") by section 5 of the Commissioners for Revenue and Customs Act 2005 (c. 11). Section 50 of that Act provides that, insofar as is appropriate in consequence of section 5, a reference to the former Commissioners is to be read as a reference to the new Commissioners.back
