The Judicial Pensions and Retirement Act 1993 (Addition of Qualifying Judicial Offices) Order 2007

  Made 5th March 2007 
  Laid before Parliament 6th March 2007 
  Coming into force 1st April 2007 

The Lord Chancellor makes the following Order in exercise of the powers conferred on him by sections 1(8), 26(9) and 29(3) of the Judicial Pensions and Retirement Act 1993[1].

     1. This Order may be cited as the Judicial Pensions and Retirement Act 1993 (Addition of Qualifying Judicial Offices) Order 2007 and comes into force on 1st April 2007.

    
2. In Part 2 of Schedule 1 to the Judicial Pensions and Retirement Act 1993 (offices which may be qualifying judicial offices), at the end of the list under the heading "Members of tribunals" insert—

     3. The amendment in article 2, adding the Asylum Support Adjudicator to Part 2 of Schedule 1 to the Judicial Pensions and Retirement Act 1993, does not apply to a person appointed to the office of Chief Asylum Support Adjudicator before 1st April 2007.

    
4. At the end of Schedule 5 to the Judicial Pensions and Retirement Act 1993 (retirement provisions: the relevant offices), insert—

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Judicial Pensions and Retirement Act 1993 by adding to the list of qualifying judicial offices in Schedule 1 and also to the list of relevant offices in Schedule 5 to that Act.

The office of Asylum Support Adjudicator becomes a qualifying office for the purpose of the 1993 Act; but the office of the Chief Asylum Support Adjudicator will only become a qualifying office in relation to a person appointed on or after the coming into force of this Order. The President of the Charity Tribunal will also become a qualifying office for the purpose of the 1993 Act.

Asylum Support Adjudicators will become relevant offices for the purpose of Schedule 5 to the 1993 Act so that the provisions about retirement in section 26 of the 1993 Act will apply to persons holding the office of an Asylum Support Adjudicator. The President of the Charity Tribunal is not being added to Schedule 5 because the Charities Act 2006 already makes provision about retirement.
