EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Accession (Immigration and Worker Registration) Regulations 2004.

The 2004 Regulations established a worker registration scheme for workers from eight of the States that acceded to the European Union on 1st May 2004. Under that scheme workers from those States who begin working for an employer in the UK on or after 1st May 2004 are generally required to apply, within one month of beginning work, for a registration certificate authorising them to work for that employer. Regulation 8 of the 2004 Regulations sets out the procedure applying to an application for a registration certificate.

Under regulation 8(4) of the 2004 Regulations, as amended by the Accession (Immigration and Worker Registration) (Amendment) Regulations 2005, an application by a worker who has not previously registered under the worker registration scheme must be accompanied by a registration fee of £70. The registration fee is intended to cover the administrative costs of registration. These Regulations increase that fee to £90 in relation to applications made on or after 2nd April 2007. The 2005 Regulations, which are superseded by these Regulations, are revoked.
