The Secretary of State makes the following Order in exercise of the powers conferred by section 21(5) and (6) of the School Standards and Framework Act 1998(1) and regulation 25(1)(c) of the Education (Foundation Body) (England) Regulations 2000(2).

Citation and commencement

1.  This Order may be cited as the Bourne Foundation (Dissolution) Order 2016 and comes into force on 5th January 2017.

Dissolution

2.  On 6th January 2017 the Bourne Foundation is dissolved.

3.  For the purpose of article 2, "the Bourne Foundation" means the body corporate known as the Bourne Foundation established under section 21 of the School Standards and Framework Act 1998.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order provides for the dissolution on 6th January 2017 of the Bourne Foundation, a foundation body. A foundation body is a body corporate established under section 21 of the School Standards and Framework Act 1998 to perform certain functions in relation to a group of three or more schools, namely to hold property and appoint foundation governors for those schools. Membership of the group of schools for which the Bourne Foundation was performing functions has fallen below three. In accordance with regulation 25(1)(a) of the Education (Foundation Body) (England) Regulations 2000 the clerk to the Bourne Foundation has informed the Secretary of State that this is the case and, in accordance with regulation 25(1)(c) of those Regulations, the foundation body must be dissolved.

An impact assessment has not been produced for this instrument as it has no impact on businesses and civil society organisations. The instrument has a minimal impact on the public sector.
