The Animals (Scientific Procedures) Act 1986 (Fees) (No. 2) Order 2018

The Secretary of State makes the following Order in exercise of the powers conferred by section 8 of the Animals (Scientific Procedures) Act 1986(1).

Citation, commencement, interpretation and extent

1.-(1) This Order may be cited as the Animals (Scientific Procedures) Act 1986 (Fees) (No. 2) Order 2018 and comes into force on 20th August 2018.

(2) In this Order, the "1986 Act" means the Animals (Scientific Procedures) Act 1986.

(3) This Order extends to England and Wales and Scotland.

Fees payable for new licences granted under the Animals (Scientific Procedures) Act 1986 for the period beginning with 20th August 2018 and ending with 5th April 2019

2.  Article 3 applies where a person is granted a licence of the kind mentioned in that article during the period beginning with 20th August 2018 and ending with 5th April 2019 and is not required to pay any fee under the Animals (Scientific Procedures) Act 1986 (Fees) Order 2015(2).

3.-(1) In addition to any fees payable under the Animals (Scientific Procedures) Act 1986 (Fees) Order 2018(3), in respect of the period beginning with 20th August 2018 and ending with 5th April 2019, the holder of a licence issued under section 2C of the 1986 Act (licensing of undertakings)(4) which authorises the holder to carry on an undertaking involving any of the activities mentioned in section 2B(2) of the 1986 Act (prohibition of unlicensed undertakings)(5) must pay a fee which is to be determined as follows.

(2) The additional fee is to have a fixed and a variable element.

(3) The additional fixed element for such a licence which is in force for the whole or any part of that period is £631.

(4) The additional variable element is £242 for each person who during the whole or any part of that period holds a personal licence which specifies the establishment of the section 2C licence holder to which the licence relates as the place where the personal licence is primarily available.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order, which extends to England and Wales and Scotland, prescribes additional fees payable, in respect of the period beginning with 20th August 2018 and ending with 5th April 2019, by the holder of a licence issued under section 2C of the Animals (Scientific Procedures) Act 1986 who is granted that licence during that period. The fees prescribed by this Order are in addition to any fees prescribed in the Animals (Scientific Procedures) Act 1986 (Fees) Order 2018. In accordance with Article 2 these extra fees only apply where the person granted the licence is not required to pay a fee under the Animals (Scientific Procedures) Act 1986 (Fees) Order 2015.
