The Scottish Ministers, in exercise of the powers conferred by section 125(3) of the Environment Act 1995[1], hereby make the following Order: Citation and extent 1. - (1) This Order shall be cited as the Environment Act 1995 (Commencement No. 19) (Scotland) Order 2000. (2) This Order extends to Scotland only. Provision coming into force on 1st January 2001 2. - (1) The provision of the Environment Act 1995 mentioned in paragraph (2) below shall (insofar as not already in force) come into force on 1st January 2001. (2) Section 120(1) of the Environment Act 1995 insofar as it relates to paragraph 29(26) of Schedule 22. SAM GALBRAITH A member of the Scottish Executive St Andrew's House, Edinburgh 29th November 2000 EXPLANATORY NOTE (This note is not part of the Order) This Order, which extends to Scotland only, brings into force on 1st January 2001 section 120(1) of the Environment Act 1995 (c.25) insofar as it relates to paragraph 29(26) of Schedule 22, which inserts sections 49A (enforcement notices as respects discharge consents) and 49B (appeals against enforcement notices) into the Control of Pollution Act 1974 (c.40). NOTE AS TO EARLIER COMMENCEMENT ORDERS (This note is not part of the Order)
