Child Minding and Day Care (Registration and Annual Fees) Regulations 2001

  Coming into force 2nd July 2001 

In exercise of the powers conferred on the Secretary of State by sections 79F(1)(b) and (2)(b) and 104(4) of, and paragraphs 6(4) and 7 of Schedule 9A to, the Children Act 1989[1], the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation and commencement
     1.  - (1) These Regulations may be cited as the Child Minding and Day Care (Registration and Annual Fees) Regulations 2001 and shall come into force on 2nd July 2001.

    (2) These Regulations apply only in relation to England.

Interpretation
    
2. In these Regulations "the Act" means the Children Act 1989.

Registration
    
3.  - (1) The prescribed fee for the purposes of section 79F(1)(b) of the Act (child minding) is £14.00.

    (2) The prescribed fee for the purposes of section 79F(2)(b) of the Act (day care) is - 

Annual fees
    
4.  - (1) The following fees are prescribed for the purposes of paragraph 7 of Schedule 9A to the Act (annual fee) - 

    (2) The fee is payable annually on the anniversary of registration for child minding or providing day care.

Fee payable for issue of copy certificate where original has been lost or destroyed
    
5. The prescribed fee for the issue of a copy certificate of registration for child minding or providing day care under paragraph 6(4) of Schedule 9A to the Act is £5.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations prescribe the fees under section 79F of the Children Act 1989 in relation to registration for child minding or providing day care.

The Regulations also prescribe the annual fees to be paid by child minders and those providing day care under paragraph 7 of Schedule 9A to the Children Act 1989 and the time at which they should be paid. They also prescribe the fee payable for a replacement certificate where the original has been lost or destroyed.

The old fees payable under the Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991 (S.I. 1991/2076 as amended by S.I. 1996/3180) are set out in column 1 of the following table and the new fees under these Regulations are set out in column 2.
