SECURITY INDUSTRY, ENGLAND AND WALES

The Private Security Industry Act 2001 (Commencement No. 5) Order 2004

  Made 4th October 2004 

The Secretary of State, in exercise of the powers conferred upon him by section 26(2) of the Private Security Industry Act 2001[1], having consulted the Security Industry Authority in accordance with section 24(4) of that Act, hereby makes the following Order:

     1.  - (1) This Order may be cited as the Private Security Industry Act 2001 (Commencement No. 5) Order 2004.

    (2) In this Order "the 2001 Act" means the Private Security Industry Act 2001.

    
2. Section 3(1) and (2)(a) to (i) of the 2001 Act (conduct prohibited without a licence) shall come into force on 18th October 2004 in the police areas[2] of - 

     3. Section 3(1) and (2)(a) to (i) of the 2001 Act (conduct prohibited without a licence) shall come into force on 15th November 2004 in the police areas of -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings section 3(1) and (2)(a) to (i) of the Private Security Industry Act 2001 into force on 18th October 2004 in the Leicestershire, Northamptonshire, Staffordshire, Warwickshire, West Mercia and West Midlands police areas and on 15th November 2004 in the Cheshire, Cumbria, Greater Manchester, Lancashire and Merseyside police areas. Section 3(1) creates an offence of engaging in any licensable conduct except under and in accordance with a licence and section 3(2)(a) to (i) identifies certain forms of licensable conduct for the purposes of the Act.
