POLICE, ENGLAND AND WALES

The Police Act 1997 (Criminal Records) (Amendment) (No. 3) Regulations 2004

  Made 4th October 2004 
  Laid before Parliament 7th October 2004 
  Coming into force 1st November 2004 

The Secretary of State, in exercise of the powers conferred upon him by section 125(1) and (5) of the Police Act 1997[1], and having regard to the meaning of "prescribed" in section 119(3) of that Act[2],hereby makes the following Regulations:

Citation, commencement and extent
     1.  - (1) These Regulations may be cited as the Police Act 1997 (Criminal Records) (Amendment) (No. 3) Regulations 2004 and shall come into force on 1st November 2004.

    (2) These Regulations extend to England and Wales.

Fees payable to police authorities for information provided to the Secretary of State
     2. For Schedule 3 to the Police Act 1997 (Criminal Records) Regulations 2002[3] there shall be substituted the Schedule to these Regulations.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Police Act 1997 (Criminal Records) Regulations 2002 by inserting a new Schedule 3 setting out revised fees payable to the police for each request for information under sections 115, 116 or 120A(4) of the Police Act 1997. The amendments have effect from 1st November 2004.
